General Terms and Conditions of WTG Academy

1. Registration and conclusion of contract

Registration for a German course takes place online or in person at the language school premises and becomes binding when the registration form is signed and confirmed in writing by email by the WTG Academy.

By registering, participants accept these General Terms and Conditions.

The language school WTG Academy does not guarantee the achievement of a specific level according to the CEFR. Only attendance of the booked course level and courses is guaranteed.

The WTG Academy language school offers its courses in hybrid form. Participants have the option of attending the course both online and in person.

General regulations:

The duration of a UE (teaching unit) is 45 minutes. The allocation of teachers is the sole responsibility of the management of the WTG Academy language school. The WTG Academy language school also reserves the right to change a teacher during the course. The change of teacher is not a reason for a refund claim or special termination.

The language school WTG Academy accepts no liability for the passing of any examinations.

There are no lessons on public holidays. There are no alternative dates for these. The customer is not entitled to a pro rata refund or to attend further follow-up lessons that are not part of the booked quota.

At the beginning of each intensive course, a placement test is carried out or a language certificate not older than one year is presented. If the level of a course participant after the placement test does not correspond to the required level of the booked course according to the CEFR, the language school WTG Academy alone is responsible for deciding whether the participant remains in the course. The customer has no legal claims arising from this process, in particular the reduction of the course fee and also a special right of termination are excluded.

Due to the sales tax exemption according to § 4 No. 21 UstG, no sales tax will be shown on any invoice.

2. Payment conditions

The course fees are due before the start of the course and can be paid in installments or in full.

In the event of late payment, the WTG Academy reserves the right to charge reminder fees and to exclude the participant from the course and to use the debt collection services of Miamono.

3. Right of withdrawal and cancellation

If you register online, you can cancel your course registration free of charge up to 14 days before the start of the course in accordance with § 312g right of withdrawal.

If you have concluded a training contract on site, i.e. directly on the premises of the language school / WTG Academy, there is no statutory right of withdrawal.

The period begins after the binding application and receipt of this instruction with the school contract by email in accordance with information obligations pursuant to Article 246 § 2 in conjunction with § 1 paragraph 1 and 2 EGBGB and our obligations pursuant to § 312g paragraph 1 sentence 1 BGB in conjunction with Article 246 § 3 EGBGB. The applicant must enter a correct e-mail address when submitting the application; if an incorrect e-mail address is entered, only the applicant is liable.

Cancellation must be made in writing, either via this link: https://wtg-academy.com/antrag-auf-annullierung-des-kurses/ or by post to Sprachschule WTG Academy Marktstraße 6 in 65428 Rüsselsheim.

Course fees will not be refunded if the course is canceled or interrupted at a later date.

After the withdrawal period of 14 days has expired, there is no possibility to withdraw from the contract for this reason.

If the start of the course is within the 14-day withdrawal period, the right of withdrawal can no longer be exercised from the start of the course.

In exceptional cases, a partial refund or the transfer of fees to another course may be granted at the discretion of the WTG Academy. In this case, the following conditions apply.

The language school WTG Academy offers every participant the opportunity to attend all course lessons as booked, but actual attendance is the responsibility of the customer.If individual or several lessons cannot be attended, the customer is not entitled to a pro rata refund, a cancellation or to attend subsequent lessons that were not originally booked.

The WTG Academy reserves the right, for organizational or other valid reasons (such as health recommendations or official orders), to change the modality of the course offering between face-to-face lessons, hybrid models or purely online lessons. Such a change to the course modalities does not entitle the participant to withdraw from the course, postpone the course or receive a refund of the course fees. Participants acknowledge that such adjustments may be made in the best interests of all parties and to maintain course quality.

4. Termination of the contract by the language school

1. Ordinary termination: The language school may terminate the contract with four weeks’ notice to the end of the month. The notice of termination must be in writing and will be sent to the course participant by e-mail or post.

2. Extraordinary termination: The language school is entitled to terminate the contract extraordinarily for good cause without observing a notice period. Good cause shall be deemed to exist in particular if:

a. The course participant is in arrears with the payment of course fees despite a written reminder.

b. The course participant repeatedly and significantly violates the house rules or the conditions of participation and thereby significantly disrupts the course or other participants.

c. The course participant behaves in a manner that seriously damages the reputation of the language school.

3. Consequences of termination: In the event of ordinary termination by the language school, the course fees already paid for unused services will be refunded on a pro rata basis. In the event of extraordinary termination, there is no entitlement to a refund of the course fees.

4.Form of termination: Notice of termination must be given in writing and shall take effect as soon as it is received by the course participant.

5. Written form: The notice of termination must be in writing and must be sent by post or e-mail. Proof of receipt lies with the terminating party.

6. Objection: The course participant has the right to lodge an objection in writing within two weeks of receipt of the notice of termination. The language school will examine the objection and inform the course participant of its final decision within a further two weeks.

5. Trial lesson:

Right to a trial lesson: Every course participant has the right to take part in a free trial lesson. This trial lesson lasts approximately 45 minutes and takes place in one of our current courses.

Purpose of the trial lesson: The purpose of the trial lesson is for the prospective student to get to know the teaching style, the teaching methods and the course atmosphere in order to decide whether the course meets their expectations and needs.

Prerequisite for participation: The trial lesson must take place before the final course registration. Prior registration for the trial lesson is required to determine a suitable date and course.

Increasing satisfaction: The possibility of a trial lesson is intended to increase participant satisfaction and reduce the likelihood that the course will be canceled after it has started.

Signing up for a trial lesson: Interested parties can register for a trial lesson by telephone, by e-mail online at this link https://wtg-academy.com/registration-for-a-free-german-trial-session/ or directly on site. The language school will confirm the date and the course room for the trial lesson.

Conditions: The trial lesson is non-binding and free of charge. After the trial lesson, the participant can decide whether they wish to register for the course.

6. Course postponement

If the minimum number of five participants per course is not reached, the language school WTG Academy reserves the right to postpone the course. The course may be postponed until the required number of participants has been reached.

If, in exceptional cases, payment by installments has been agreed for the language course, the installments must be paid on the agreed dates. If the installments are not paid on time, the agreement is no longer valid and the total amount is due from the date of the missed installment.

The language courses of the WTG Academy language school take place regularly from Monday to Friday from 09:00 to 12:00 in the morning, from 15:00 to 18:00 in the afternoon and from 18:00 to 21:00 in the evening. The language school WTG Academy reserves the right, for organizational reasons, to postpone the start time of courses by up to one hour (08:00) or up to three hours (12:00).

In the event of a postponement of the start time, the customer shall not be entitled to any claims whatsoever, and in particular may not withdraw from the contract. The course fee remains owed as contractually agreed and the reimbursement of course fees already paid is excluded in this case. If lessons cannot be held due to force majeure, the customer has no right to a refund or to make up lessons that have not taken place. In exceptional cases, a full partial refund may be arranged at the discretion of the WTG Academy.

Changes to the course program, instructors or lesson plan may occur and do not entitle the customer to a price reduction or cancellation.

7. Special provisions for small numbers of participants

If four or fewer participants are registered for an intensive course, the teaching time will be adjusted to two to three lessons instead of four lessons per day. This does not entitle the customer to a reduction in the course price or a special right of termination.

8. Special provisions for individual lessons and company courses

For private and company courses, the booked lessons can be arranged flexibly and directly with the teacher.

It is the responsibility of the course participant to keep the agreed appointments. Missed and uncancelled appointments before at least 24 hours will be charged in full and deducted from the customer’s booked quota.

If an appointment is canceled more than 24 hours before the scheduled start of the session, the lessons will not be charged and a new appointment can be arranged.

Please note that the postponement or cancellation must be communicated appropriately and only in writing.

9. Special provisions for course registration for visa purposes

The following provisions apply when booking language courses for the purpose of obtaining a visa:

When registering, the customer is obliged to state that the course is a language course for the purpose of applying for a visa. This applies to any course for which a visa application is made to an authority. The withdrawal period of 14 days is excluded for visa courses.

The customer has the option of postponing the start of the booked course – even several times.

Any postponement of the course must be notified to the language school in writing before the start of the language course.

The customer is obliged to pay the course fee in full in advance.

If the competent authority refuses to grant the visa, the deposit paid shall be refunded less a processing fee of 25% of the course fee if the language school is notified of the refusal by the competent authority no later than four months after the planned original start of the course. If the rejection notice is not submitted on time, a refund is excluded.

A refund of the deposit is also excluded if a postponement of the course initiated by the customer is not notified in writing before the start of the course or if the start of the course has been postponed by the customer by more than four months in total.

It will be refunded if:

the customer informs the language school in writing before the start of the course that I will not be able to arrive on time for the start of the course.

AND:

If he/she submits the rejection letter within 4 months of the scheduled course start date.

The deposit will not be refunded if:

The customer does not inform the language school in writing before the start of the course that I cannot come.

OR:

If the customer does not submit the rejection letter within 4 months of the scheduled course start date.

10. Liability

The WTG Academy is not liable for participants’ personal belongings.

Participation in all courses and events is at the participant’s own risk. Furthermore, the WTG Academy is not liable for damage, accidents and injuries to course participants in or on the way to the language school in Rüsselsheim.

11. Data privacy

Participants’ personal data will be treated in accordance with the applicable data protection laws and will not be passed on to third parties unless there is a legal obligation to do so.

12. Final provisions

Amendments or additions to these General Terms and Conditions must be made in writing.

Should individual provisions of these General Terms and Conditions be invalid, the validity of the remaining provisions shall remain unaffected.
